Maryland ( MD ) Wage and Hour Laws

It is important for both employers and employees to keep up with current Maryland (MD) wage and hour laws. These laws serve to establish a standard for all workers and employers.

In the year 2006 Maryland’s minimum wage was increased to $6.15 per hour. In addition, the minimum wage for tipped employees has increased to $3.08 per hour plus tips. If a tipped employee’s wages including gratuities do not make up $6.15 per hour employers must make up the difference. Furthermore, when a tipped employee is assigned a non-tipped task that worker must be paid the standard minimum wage for doing that task.

Maryland employees are only required to give a 30 minute break after five hours worth of work to those aged 17 and younger. In addition, Maryland (MA) wage and hour laws state that breaks offered to workers over 18 must be paid for if those breaks are 20 minutes or less. Any breaks over 20 minutes do not have to be paid for if that adult employee is allowed to leave the premises and is not called back to work during that time.

Overtime must be paid to employees who work more than 40 hours within a seven day work week. Those who work overtime will be paid 1 ½ times the regular pay for those extra hours work. Employers in Maryland that are not required to pay overtime include interstate trucking companies, hotels, restaurants, gas stations, private country clubs, and others.

In addition, Maryland (MD) wage and hour laws state very clearly that paid hours such as holiday time, sick leave, vacation days, or time off are not counted as actual work hours. Therefore, those hours do not count towards overtime pay.

Maryland (MD) wage and hour laws also have provisions for minors. For instance, workers under 18 are limited to the number of hours they can work on school days. In addition, some workers under 14 who work in the entertainment industry can obtain special permits. More provisions are made for minors within Maryland wage and hour laws.
