Montana (MT) Minimum Wage Posters

Most of the United States, including Montana, uses the Federal minimum wage law for non-exempt employees. The Federal minimum wage posters clearly show the current minimum wage of $5.15 for each hour worked. However, back in 2005, the State House of Representatives defeated State Bill 78 which could have increased the minimum was in Montana over two periods, as well as changing the tip credit. More importantly, voters will be able to weigh-in on a different increase in the form of Initiaitive 151, which could increase minimum wages to $6.16.

Currently, small employers, those with total annual gross sales do not exceed $110,000, are able to pay their employees a different minimum wage of only $4.00. Of course, if the employee is non-exempt, he or she may receive a premium wage of one and one-half times this rate is paid for overtime worked (over 40 hours in one week).

The Federal Fair Labor Standards Act (FLSA), originally enacted back in 1938, continues to expand the classes of workers who are and are not covered under minimum wage guidelines. The most common class of excluded employees is tipped employees, which includes most restaurant personnel, including waiters, waitresses, and bus persons. The definition of a tipped employee includes those who “customarily and regularly” receive tips and whose tips exceed $30 a month. Full-time students can also discover that they’re being paid less than the minimum wage by their employer, which is completely within these guidelines.

The rules governing these special classes of employees can be very complex and hard to understand. A number of special exceptions include full-time students and qualified disabled workers. Laws regarding wage-related rights and responsibilities are designed to protect employees from being underpaid. The Montana Minimum Wage Posters must be clearly visible by all employees and posted in a central location.
