IN Labor Laws
September 16th, 2006 Posted by JaredFinding Indiana (IN) Labor Laws online was fairly easy, although there are many of them. They are similar in nature to many of the other states’ labor laws. In many cases, IN labor laws must be posted around the work place on easily obtained publications, called Indiana Labor Law Posters. Employers need to hang these posters in areas of the business where employees can have access to them. Places like the employee break room, work area and employee time clock are prefect areas to display these posters.
Indiana is known as an “employment at-will” state. This means that there are no laws preventing the hiring, firing, promotions, layoff, or suspension of an employee by an employer. However, IN labor laws do state that an employer cannot discriminate against someone based on their disability, age, gender, religion and race.
IN labor laws also state that an employer is not permitted to “fine” and employee and deduct that amount from their wages. In order to get such a fine or monetary amount, the employer must have a court order to do so.
Indiana also has a labor law known as the “Blacklisting Law”. In this law, it is stated that employers may NOT make false statements about former employees to prospective employers. When an employee believes this is happening to him or her, he or she must request copies of correspondence between the two within 30 days of applying for the wanted job.
The minimum wage in Indiana follows the minimum wage set by the federal government, which is currently $5.15 per hour. When an employee works overtime, or over 40 hours in any given work week, then the employer is required to pay one and one half times the hourly rate of the worker’s per hour rate. Some workers are exempt from this minimum wage law.
