SD Labor Laws

The South Dakota (SD) labor laws follow along with the federal government on most everything. I found the frequently asked questions page dealing with SD labor laws very easily. The labor laws in effect are understandable and follow along with other states pretty closely.

Some of the SD labor laws are required by law to be placed on publications called South Dakota labor law posters. These need to be hung somewhere in the business for employees to see. A lot of employers will place these posters on the walls around the time clock or in the employee break room, as those are both conspicuous areas where they will be found without any trouble.

The first of the SD labor laws I found deals with the minimum wage. The minimum wage in South Dakota is currently $5.15 per hour, as required by the federal government. There are no labor laws in the state of South Dakota that require overtime pay, meal breaks, or holiday pay. If the employer is subject to FLSA (Fair Labor Standards Act), then overtime and meal breaks will be given based on those federal labor laws.

Another labor law that is in effect in many states but I haven’t mentioned yet is all about those employees who are called for jury duty. Many times a state labor law will prohibit the firing of an employee due to being called for jury duty and the SD labor laws are no different. Even though the employee cannot be fired, it is still up to the employer whether that worker will get paid for that time.

The last SD labor laws I will speak about are child labor. Minors in this state are subject to labor laws that a pretty much identical to the other states’. The most important of these SD labor laws is the one which prohibits minors from holding a job considered to be “hazardous” to the minor’s health. Others deal with minimum age a minor can work and the hours a minor can work each day and for a work week.
