Virginia (VA) Minimum Wage Posters

Virginia, like that of most of the United States and its territories, still uses the Federal minimum wage law for all of its non-exempt employees. This wage of $5.15 per hour is duly noted on Virginia Minimum Wage Posters. In addition to this regular rate, there is a premium, or overtime wage, equal to one and one-half times applies to all non-exempt workers. By Virginia guidelines, this provision applies to both service and retail positions, to include all commercial support service, food and beverage, as well as throughout the health and medical industries.

Back in 1938, the Federal Equal Employment Opportunity Commission (EEOC) established the Fair Labor Standards Act (FLSA). Over the years, many changes have been made to the Act which has expanded the classes of workers covered for minimum wage. The FLSA applies to employees who has been in business at least a year and who exceed $500,000 in revenue. Smaller firms may also have to comply if they have employees who work in transportation or interstate communications businesses; it’s the employer’s responsibility to make sure that they are following the current rules and regulations.

However, there are still cases where there may be some perceived discrepancy between the State and the Federal laws regarding labor in general and wages in particular. For instance, small employers, those who gross annual sales does not exceed $150,000, the overtime requirement for hours worked in one work week over 40 does not need to be paid at those stated for larger employers. On the other hand, there are some categories which already received more the Federal minimum. In those cases, the higher rate will be applied.

It is the responsibility of all employers to clearly posted the most current version of the Virginia Minimum Wage Posters in a central location visible to their employees.
