SD Laws
September 20th, 2006 Posted by HeatherSD laws that pertain to employment are established to help both employers and employees know their rights and responsibilities. These laws are updated periodically.
One section of SD laws includes the provision made for workers’ compensation. These laws answer all the questions that both workers and industries would ask. For instance, an employee may need to know when an injury needs to be reported. In this case, the injury must be reported within three working days.
SD laws also outline safety prevention measures to ensure that the least possible amount of injuries take place in one year. For instance, regulations on the use of hazardous chemicals as well as guidelines for elevator safety are recorded in these laws.
Other SD laws pertain to wage and hour regulation in the state of South Dakota. For instance, employers are to pay employees who have been terminated their last check on the next regular payday after an employee quits. These state laws do allow the employer to hold that employee’s check until all equipment and materials (such as uniforms and safety gear) are returned.
Another purpose of SD laws is to protect those who serve in jury duty. These laws prohibit an employer from firing an employee who is required to serve in this practice. This time off can be given by the employee with or without pay.
One more of the many aspects of employment issues that are addressed by SD laws are those that pertain to child labor. These South Dakota laws indicate various limitations, such as that of the number of hours that minors can work during school hours. Additional guidelines pertaining to child labor include a list of which types of jobs are suitable for which age group of minors-under 14, 14 to 15, and 16 to 17 years old groups.
All employers and employees are advised to keep track of all these employment laws. These are usually displayed on the premises of most places of employment.
