Tennessee (TN) Labor and Employment Laws

While it is true that most labor laws are in place to protect the employee, there are many things that workers take for granted as law which simply are not. Tennessee (TN) Labor and Employment Laws cover all aspects of employment in all industries. Employers and employees both have rights and responsibilities under these laws.

Tennessee is known as an employment at will state which generally means that an employer may suspend or discharge an employee without warning and without cause. Employees are protected under Tennessee (TN) Labor and Employment Laws from being terminated or otherwise denied employment on the basis of race, color, religion, sex, national origin, age, handicap, marital status or familial status. There is also a Whistleblowers Act, which protects workers from any reprisal or adverse action, including termination by their employer for notifying their employer, or reporting them for workplace violations or for refusing to participate in unlawful practices.

Tennessee (TN) Labor and Employment Laws do not have any specifics independent of the federal statutes with regard to minimum wage, overtime or salaried employees. Employers are required to give employees a meal period of at least 30 minutes for working 6 hours or more unless the job allows for downtime or small breaks throughout the course of the workday.

Minors are not required to obtain work permits under Tennessee (TN) Labor and Employment Laws, however employers should have information on file about the minor including their age and must adhere to prohibited occupations and limited working hours.Safety in the workplace is also a big concern and there are several aspects of the law to deal with such matters. Employers with 5 or more employees, or in the case of construction or coal mining one employee are required to carry Workers Compensation Insurance. This protects both the employer and employee in the event of workplace illness, injury or fatality.
