New Alabama Child Labor Rules Take Effect
September 5th, 2008 Posted by JolieThe Alabama Department of Labor recently took the opportunity to remind employers that with school in session, new regulations apply to those who employee workers under the age of 19.
The regulations take effect on the first day of school, so the date will be slightly different in various areas.
All minors under 18 must have work permits to be legally employed. Permits are issued at all city and county Boards of Education, and at many high schools in the state. Many private schools also issue permits.
According to the Alabama Department of Labor, violations to the state child labor laws have increased in the past 6 months. Most of these violations have involved youths working more hours than permitted, or during prohibited hours. Many of the violations have resulted in misdemeanor charges being filed against employers who violate the hour restrictions.
Under the federal GINA, employers who have a fatal accident involving a worker under 18 can be fined up to $50,000.
Under Alabama law, young people aged 14 and 15 cannot work during the school hours, considered 8 am to 3 pm. They can work between 3 pm and 7 pm on weeknights. They are also permitted to work up to 8 hours per day on the weekend, but cannot work more than 18 hours total per week.
Youths who are 16, 17 or 18 and enrolled in high school may not work past 10 pm on any night that precedes a school day. This means Sunday night through Thursday night, most weeks.
When school is not in session, Alabama youth workers may put in up to 8 hours per day, or 40 hours per week. However, they cannot work more than 6 days per week. Federal law also requires breaks for young workers.
Young people with a high school diploma, or those who are no longer in school, are not restricted in the hours that they may be employed.
