New Hampshire Right to Know Law

I’ve been interested in watching New Hampshire’s Right to Know law debate. If you haven’t heard about it, a bill was drafted in order to help the public gain the same access to all the same technological records, such as email, that they have to paper records. The bill clarifies that computer and email records are covered by law.

The reason the Right to Know law has become such a hot topic is the growing popularity of technological means of communications. Emails, faxes, and teleconferences all are choices that are used by many employers. But management has to be careful. Those are all electronic records, which have to be made available to the employee just like any sort of paper records.

I know if you’re an employer in New Hampshire, you’re already aware of another right-to-know issue. That is the right of your employees to know that there are toxic substances present in the workplace. Workers must be notified of long and short term health hazards of any substance they might come in contact with. They must be properly trained in handling toxic substances. It is my understanding that employees have the right to request data sheet on any toxic substance they come in contact with, and that the employer must respond to this request within 5 days.

Workers must be made aware of their Right To Know about toxic substances through one of the posters that is mandatory in the workplace. Legislature has mandated that employers post the notices in every work place in order to make employees aware of their rights and remedies that are available in New Hampshire. In addition to Right To Know, New Hampshire employers must post notices about Unemployment, the Minimum Wage Law, OSHA, the Whistleblower’s Protection Act, and more.
