New April I-9 Form Deadline

The deadline for employers’ compliance with changes to the I-9 form is April 3, 2009.

 

Essentially, the U.S. Citizenship and immigration Services, the agency in charge, has given employers a several-weeks respite.

 

Action by the new Presidential administration has helped the cause of those seeking a delay. Numerous employment law and regulatory deadlines put into action by the Bush Administration during its final months were postponed recently. Chief of Staff of the White House, Rahm Emmanuel, put out a memo urging federal agencies to take an additional 60 or 90 days to review all of those policies. The intention was to insure that the policies would be consistent with the standards of President Barack Obama.

 

An interim rule published by the USCIS in December of 2008 originally required all employers in the U.S. to begin using a new I-9 form by February 2, 2009. Under the new regulations, (more…)

New 2009 FMLA Tracking Rules

A significant change to the FMLA regulations affects how employers must track FMLA leave. This is the fourth in a continuing series of articles on the new FMLA regulations issued by the U.S. Department of Labor, which go into effect  on January 16, 2009.

 

Under the old regulations, an employer had to track FMLA leave using the shortest period of time that their payroll system could track. If the payroll system rounded to the quarter-hour, the employer was required to permit the employee to use 45 minutes of FMLA leave, or 2.25 hours of FMLA leave, on a particular day.

 

The new FMLA regulations in their entirety can be found in the 201 pages of the November Federal Register.

 

Under the 2009 regulations, employers may track FMLA leave using the shortest increment that the employer uses to track other forms of leave, such as (more…)

OSHA Releases New Crane and Derrick Regulations

In response to a number of fatal accidents involving cranes, OSHA announced new regulations regarding crane and derrick safety on September 18. Employers can comment on the regulations published in the Federal Register, however, OSHA reserves the right to adopt the regulations as is without further notice.
