Employers Limit Liability at Holiday Parties

Traditional holiday parties can be a major liability risk for any employer, whether they are company-sponsored or impromptu gatherings of employees.

 

Employers who serve alcohol at company-sponsored events may be liable, if an employee chooses to drive under the influence and causes an accident, according to the U.S. Department of Labor. Some companies have been held liable for fatal accidents when the courts ruled that employees attended the parties within the scope of their employment.

 

When parties are held on work premises, or during work hours, an employee who is injured may be eligible for workers’ compensation. This is true whether the party is officially sanctioned or a spontaneous gathering of coworkers.

 

In one extreme example, a Chicago-area boutique employee suffered a spinal injury at a holiday party in a local bar. The employee was dancing with her boss’ husband when the inebriated man tried to lift her off the floor and twirl her around. He dropped the employee, who hit her head on the floor. Because the accident occurred at a company-sponsored event, the court ruled that it was “within the scope of employment” and the worker collected a multi-million-dollar workers’ comp settlement.

States Require E-Verify

Employers in several states, including Mississippi, Colorado and Arizona, are required by law to use E-Verify to check every new employee’s documentation.

 

In Texas, Hawaii, Michigan and eleven other states, employers are strongly urged to use E-Verify.

 

Tax incentives are offered in some states, like Georgia, to employers that utilize E-Verify. Government employees, state contractors and sub-contractors are already required to use E-Verify by most states.

New Hampshire Minimum Wage Increases Again

On September 1, 2008, the minimum wage for New Hampshire employers will increase the second time in a matter of weeks. On July 23, 2008 the state minimum wage was $6.50 per hour. The federal minimum wage increase on July 24 meant that most New Hampshire employers had to pay $6.55 per hour.

New Federal Online Flood Recovery Resources

The US Department of Labor recently announced a one-stop internet tool for employers and employees affected by the Midwest Floods of 2008.

 

“We want to make information easily accessible and help quickly available to Americans affected by the devastating flooding in the Midwest,” said Secretary of Labor Elaine L. Chao. “In addition to our toll-free telephone number, we’ve set up a Midwest Flood Recovery Assistance Web page to guide affected residents on unemployment insurance, personal safety during cleanup operations and many other helpful resources for workers and employers.”

 

Some in the Midwest are calling the 2008 floods the “Hundred Year Floods.” In Lake Delton, the overflow nearly drained a lake, destroying the area’s popular Wisconsin Dells resort industry. Further downstream, many towns have virtually been wiped out by flooding – even those FEMA claimed were in no danger.
