Virginia Releases Mandatory Update to VOSH Poster

Virginia employers are required to keep their workers up to date on health and safety standards in the workplace. To assist employers, Virginia recently released a mandatory update to its Virginia Occupational Safety and Health notice. All Virginia employers must display the new poster. If you do not have the most recent version, which is dated August of 2019, your business is not in compliance with the law.

Civil Penalty Adjustments

Virginia law requires the Commissioner of Labor and Industry to adjust the maximum civil penalties for violations of Virginia Occupational Safety and Health (VOSH) regulations. The Commissioner bases the adjustment on the increase in the Consumer Price Index from the prior year.

These are the adjustments to the maximum civil penalties, effective August 1:

  • Serious violations – $13,047
  • Other-than-serious violations – $13,047
  • Failure to correct violations – $13,047
  • Willful or repeated violations – $130,463

Employers must notify workers of the annual penalty adjustments. Changes to Accident Reporting Requirements

The updated poster also includes a new section on Accident Reporting. This section advises injured employees that they have 24 hours to report in-patient hospitalization, amputation or loss of an eye.

Updating and Displaying the Poster

The “Job Safety and Health Protection” poster advises an employee of their rights and responsibilities under the OSHA law. The employer must display the poster in a public area where employees will see it. The notice is available from the Virginia Department of Labor and Industry.

An employer can be penalized for not having an updated poster displayed prominently on the job. If a business does not have the most recent poster, it can be fined up to $1,000.
