Which Labor Law Posters Are Required for Health and Safety?

Running a business properly requires you to follow all the rules and regulations put in place by labor laws. One of those regulations is the mandatory display of labor law posters. There is a list of labor law posters that are required by both the federal Department of Labor and your state’s Department of Labor.

Occupational Safety and Health Act

The OSHA poster is a legally required health and safety poster that informs employees of their rights under the Occupational Safety and Health Act. This poster must be displayed in a conspicuous place that is frequented by your employees.

Twenty-six states and Puerto Rico and the Virgin Islands have OSHA-approved State Plans, meaning their required OSHA poster will be slightly different than places that are only required to display the basic OSHA poster. If you live in one of these places, your OSHA poster might include state-specific information. These states include: Alaska, New Mexico, Arizona, North Carolina, Connecticut, Oregon, Hawaii, Illinois, South Carolina, Indiana, Iowa, Tennessee, Utah, Kentucky, Maryland, Vermont, Michigan, Virginia, Minnesota, Nevada, Wyoming, and New Jersey.

If you are a federal agency, you are required to display the OSHA Federal Agency Poster.

All other employers must display the standard OSHA poster, which includes information regarding your requirements to provide a safe workplace for your employees, and contact information for your employees to get in touch with OSHA if they need to. Because it is your responsibility to ensure that your employees understand this information, it’s a good idea to display this health and safety labor law poster in both English and Spanish if you have Spanish-speaking employees.

Family and Medical Leave Act

The FMLA poster informs employees of their rights under the Family and Medical Leave Act. This poster must be displayed at every place of employment that includes at least one employee. It explains the laws and requirements for taking a leave of absence due to prolonged illnesses, pregnancy, or for the care of a spouse, child, or parent who suffers a serious medical condition. It lays out the specific definition of a serious health condition, and explains to employees what the employer can and cannot do while they are incapacitated.

This poster gives your employees the contact information they need to get in touch with the Wage and Hour Division of the United States Department of Labor. Again, if you have Spanish-speaking employees, it’s a good idea to display this labor law poster in both English and Spanish to ensure that they have a complete understanding of their rights under the law.

Other labor law posters are required by both the federal and state government, but these two cover the main health and safety laws that protect employees and employers. Posting these posters, in their most recent form, in your workplace is required, and you could face serious fines and legal ramifications if it is discovered that your place of business does not comply with this law.
